Acceptance of conditions

All business relationships with Cowboy Kurt are subject to these terms and conditions. They apply to all current and future business transactions with Cowboy Kurt, even if not expressly mentioned.

The customer acknowledges having read, at the time of placing the order, the specific terms and conditions of sale set out below and expressly declares to accept them without reservation.

These general terms and conditions of sale govern the contractual relationship between Cowboy Kurt and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, unless otherwise agreed in advance, expressly and in writing.

The buyer agrees to comply with the provisions of this contract relating to the contractual guarantee and honors its financial obligations to Cowboy Kurt.

Retention of title

Cowboy Kurt retains ownership of all merchandise delivered until full payment is received.

Products

The buyer is responsible for verifying that the delivered items correspond to the items ordered and that they are suitable for their intended use. Photos are for illustrative purposes only and are not contractually binding.

Order

Cowboy Kurt reserves the right to cancel any order from a customer with whom there is an existing dispute regarding payment for a previous order. The information provided by the buyer when placing the order is binding: in the event of an error in the product reference or the recipient's address, the seller cannot be held responsible for any delay or non-delivery of the product.

Payment

The total price charged to the customer is the order amount plus handling and shipping fees.

Payment by bank card

To pay for your order on our site, you can use the following credit cards: Visa, Mastercard and American Express.

During the checkout process, you will be asked to enter your credit card number, the card's expiry date, and the last three digits of the security code on the back of the card. The amount will be debited immediately upon order confirmation.

In the event of stock shortages on certain items in the order or returns of goods resulting in a refund, the amount of the items concerned will be credited to your credit card as soon as possible.

All credit card payments are processed through a secure server. The information you enter is not transmitted unencrypted over the internet: it is encrypted during all exchanges using the SSL protocol, which also automatically verifies access rights when you make a credit card payment.

We therefore guarantee the complete confidentiality of your banking information and assure you that we never know or store information relating to your bank card.

Under no circumstances do we have access to your card number nor do we store it.

Payment by bank transfer (only for Switzerland)

If you prefer not to use online payment, you can send us your payment via e-banking. To do so, simply use the bank details below and pay as soon as possible. We will ship your order as soon as we receive your payment.

Delivery

After order confirmation, Cowboy Kurt Boutique commits to delivering all items ordered by the buyer within a reasonable timeframe. All orders placed with Cowboy Kurt Boutique are intended for the personal use of the customers. Customers and recipients of the products are prohibited from reselling the products, either partially or in full.

Free delivery is offered for orders over CHF 200.- (only in Switzerland).

Return of goods

The buyer (customer) has 7 days from receipt of the merchandise to return it to Cowboy Kurt Boutique. After this period, the merchandise is considered accepted by the customer. A return request must be submitted in writing for all merchandise returns. No returns will be accepted without prior written authorization.

All sale items cannot be returned.

For exchanges or refunds, please return the new item(s) in their original, undamaged packaging, along with all accessories, instruction manuals, and documentation to the following address:

Any visible defects must be reported immediately and in writing. If no claim is made within 7 days, the goods are considered accepted by the customer.

The customer is responsible for the return postage costs except in the case of a defective product or an error on our part.

Price

The price shown on the product pages does not include shipping and includes VAT by default.

The price indicated in the order confirmation is the final price, inclusive of all taxes and VAT for deliveries within Switzerland. This price includes the price of the products, handling, packaging, storage, and shipping costs.

Cowboy Kurt Boutique reserves the right to adjust prices during the year according to changes in exchange rates, purchasing conditions and to offer customers the best conditions at the time.

Disputes

Cowboy Kurt Boutique's liability will, in any event, be limited to the order amount and cannot be invoked for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products. Claims or disputes will always be received with careful attention. In the event of a dispute, the customer should first contact the company to seek an amicable solution. Failing that, Swiss law shall apply exclusively to all disputes.

The Commercial Court of the canton of Cowboy Kurt Boutique has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

Responsibility

In all cases, Cowboy Kurt Boutique cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt of the goods, nor for damages of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the products sold. The same applies to any modifications to the products made by the manufacturers.

Cowboy Kurt Boutique's liability is systematically limited to the value of the product in question, value at its date of sale, and this without any possibility of recourse against the brand, the company producing and distributing the product.
